TERMS & CONDITIONS

By creating an account or using the MerchTapp mobile or web applications, you agree to be bound by these Terms and Conditions. If you are using MerchTapp on behalf of a band, label, or entity, you represent that you have the authority to bind that entity to these terms.

MerchTapp provides a Point-of-Sale (POS) and inventory management platform designed for artists and vendors. Our service includes:

• • Contactless payment processing (via Stripe Terminal).
• • Inventory synchronization.
• • Sales analytics and reporting.

MerchTapp integrates with Stripe, Inc. to facilitate payments.

• • Relationship: You must have a valid Stripe account to receive funds. By using MerchTapp, you also agree to the Stripe Connected Account Agreement.
• • Hardware: You are responsible for ensuring your mobile device is compatible with "Tap to Pay" requirements.
• • Fees: MerchTapp charges a subscription fee as outlined in your chosen plan (Monthly/Yearly). Transaction fees are handled separately by Stripe.

You agree to:

• • Provide accurate information during signup.
• • Tax Compliance: You are solely responsible for the calculation, collection, reporting, and remittance of all applicable sales taxes, VAT, GST, or similar levies required by the local, state, provincial, or federal jurisdictions in which you operate or conduct sales. MerchTapp provides sales data for your convenience but does not act as a tax withholding agent.
• • Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. To enhance security, MerchTapp utilizes Two-Factor Authentication (2FA). You agree to maintain an active and secure secondary authentication method (such as a verified email or mobile device) and to notify us immediately of any unauthorized access to your account.

• • Our Content: The MerchTapp logo, UI design, and source code are the exclusive property of MerchTapp.
• • Your Content: You retain all rights to the product images and branding you upload. However, you grant MerchTapp a license to host and display this content to facilitate your sales.

• • Transaction Data: MerchTapp operates on a "Zero-Storage" principle for financial transactions. Once a payment is confirmed by Stripe, all sensitive transaction metadata is immediately purged from our active servers.
• • Record Keeping: You acknowledge that MerchTapp does not maintain a permanent historical ledger of individual transactions. To access your full transaction history, tax receipts, or to process refunds, you must log in directly to your Stripe Dashboard. MerchTapp is not responsible for retrieving transaction data once it has been deleted from our system.

MerchTapp is provided "as is." To the maximum extent permitted by Canadian law, MerchTapp shall not be liable for:

• • Lost profits due to app downtime during a live event.
• • Issues arising from Stripe’s payment network.
• • Hardware failure of your mobile device.

• • Renewals: Subscriptions renew automatically unless cancelled via the dashboard.
• • Refunds: Decisions on refunds are at the sole discretion of MerchTapp, subject to Canadian consumer protection laws.

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Any disputes shall be handled in the courts of Montreal, Quebec.

We may update these terms as we add new features (like French/Spanish localization). We will notify you via the email associated with your account or through a dashboard notification.
